Terms of Service

Прочетете на български

Version: 1.0 | Effective date: 14 October 2026 | Website: https://cocobook.app

1. Provider and scope

1.1. CocoBook (the “Platform”, “we”, “us”) is a software service operated by Revox Software LTD, Bulgarian Unified Identification Code (UIC) 204101301, registered office 203 Storgozia, Northern Industrial Zone, 5802 Pleven, Bulgaria, email info@cocobook.app (the “Provider”). These details must match the current Bulgarian Commercial Register entry.

1.2. These Terms govern use of cocobook.app, the web and mobile applications, connected property-management tools, customer websites created through the service, and the optional public information directory, to the extent available.

1.3. “Customer” means a person or entity using a CocoBook workspace; “Authorised User” means a person invited by a Customer with assigned permissions; “Visitor” means someone browsing a public customer site or directory; “Enquiry” means a request for information or availability, not a reservation. “Consumer” has the meaning given to a natural person acting outside their trade or profession under applicable consumer law.

1.4. Registration, activation of a subscription or use of the Platform is subject to these Terms. Before entering into a paid agreement, the Customer receives the material contractual information and accepts the agreement by a clearly labelled affirmative action.

2. Nature of the service

2.1. CocoBook supplies software as a service (SaaS), including calendars, internal booking records, availability tracking, management of properties, units and parking spaces, tasks, family/team roles, property information, pricing, reports and related functions according to the selected plan.

2.2. Where enabled, Customers may create a public page or small website for a property, publish information about it and opt in to listing it in CocoBook’s information directory. Available features may evolve and are described in the Platform and applicable plan.

2.3. CocoBook is a technology provider. It does not offer accommodation in its own name, own or operate Customers’ properties, negotiate, accept or confirm reservations on Customers’ behalf, manage guest communications, or receive any percentage-based accommodation commission.

2.4. Charges for the SaaS subscription are separate from any transactions between a Customer and a guest. CocoBook does not collect or process accommodation payments. Internal booking records, including records marked “confirmed”, reflect data entered or maintained by the Customer and do not constitute a confirmation sent by CocoBook to a guest.

3. Accounts and invited members

3.1. Customers must provide accurate registration information, keep it updated and safeguard their credentials. Customers are responsible for use of their accounts to the extent permitted by law.

3.2. Customers control workspace and property-level permissions of their invited members and must grant access only where appropriate, removing unnecessary access promptly.

3.3. Suspected unauthorised access or security incidents should be reported without undue delay to info@cocobook.app.

3.4. The service is not intended for independent registration by anyone under 18. Customers must ensure that invited members use the service lawfully.

4. Public customer websites and directory

4.1. The Customer chooses which information is public, whether to activate a hosted property website and whether to opt in to the shared directory. Directory inclusion is not automatic without the Customer’s corresponding choice or setting.

4.2. Public pages and directory entries may display a property name and description, photos, location, indicative prices, amenities, availability information, contact details or links selected and supplied by the Customer.

4.3. Content is supplied by Customers. CocoBook does not certify ownership, rights to rent, accuracy of descriptions, legal status of the accommodation business or actual availability.

4.4. External links lead to independently operated websites governed by their own terms and privacy notices.

4.5. Customers must clearly identify the actual accommodation provider and provide their own legally required business and privacy information for their hosted websites where applicable.

5. Enquiries and relationships with guests

5.1. Availability forms allow Visitors to send enquiries to the relevant Customer. Submitting an enquiry does not create a reservation, accommodation agreement, availability guarantee or acceptance of a displayed price.

5.2. Only the Customer or their designated representative sets accommodation terms, communicates with the Visitor, accepts or rejects an enquiry and, where applicable, concludes an accommodation agreement, without CocoBook acting as an intermediary in that process.

5.3. CocoBook may technically receive, store or forward form information as part of its SaaS functionality without becoming a party to the Visitor–Customer relationship.

5.4. Complaints about stays, accommodation pricing, cancellations, refunds for accommodation or property condition must be addressed to the relevant Customer. This does not affect any rights a Visitor may have against CocoBook concerning CocoBook’s own services.

6. Customer responsibility and lawful listings

6.1. The Customer is responsible for assessing whether short-term or other accommodation is lawful at a property and for complying with applicable registration, categorisation, hospitality, rental, reporting, tax, tourist levy, consumer and privacy obligations.

6.2. The Customer warrants that it has the relevant rights and permissions to operate and publish the site or listing, and that content is accurate, lawful and does not infringe third-party rights.

6.3. CocoBook does not register or categorise properties on the Customer’s behalf or certify the Customer’s right to provide accommodation. Nothing in these Terms disclaims any mandatory legal duties that apply directly to CocoBook in relation to public listings or hosting.

6.4. The Provider may request reasonable evidence supporting a particular listing, restrict its visibility or remove it where necessary under law or these Terms.

7. Subscription plans, fees and billing

7.1. Paid features are available for a monthly subscription fee shown before checkout. The applicable price, included features, taxes, any trial period and payment methods appear in the order interface.

7.2. CocoBook does not charge commissions or percentages based on enquiries, reservations, overnight stays or Customer revenue.

7.3. If automatic renewal is clearly disclosed at checkout, subscriptions renew for successive monthly periods until cancelled. Customers may stop future renewal in subscription settings or by contacting info@cocobook.app; termination ordinarily takes effect for the next billing period unless law or agreed terms provide otherwise.

7.4. Before placing a paid order, Customers are informed about the total price, billing frequency, renewal and cancellation, and consequences of non-payment. The final purchase control clearly states that placing the order creates an obligation to pay.

7.5. If payment is overdue, the Provider may notify the Customer and, after a reasonable opportunity to remedy, restrict paid functionality in compliance with applicable law without immediate deletion of data. Export and deletion are addressed in Section 11.

7.6. Changes to subscription pricing will be communicated in advance and apply only to future periods, subject to mandatory Customer rights. Undisclosed fees will not be charged.

8. Consumer withdrawal rights

8.1. Where the Customer qualifies as a Consumer and enters into a distance contract, the Customer generally has a 14-day right of withdrawal from the contract date, subject to statutory exceptions.

8.2. Withdrawal may be exercised via [ONLINE_WITHDRAWAL_URL] (where the online withdrawal facility is required under Bulgarian Consumer Protection Act Article 52a), by an unequivocal email to info@cocobook.app, or using the statutory model withdrawal form. Submissions through the online facility will be acknowledged on a durable medium without undue delay.

8.3. If the Consumer expressly requests that the digital service begin during the withdrawal period and subsequently withdraws, a proportionate charge for the service already provided may be payable only as permitted by applicable law. Merely activating an account does not automatically waive the statutory withdrawal right.

8.4. Any required reimbursement will be made within statutory time limits by the legally required method. Nothing in these Terms restricts statutory remedies concerning conformity of digital services.

8.5. This Section applies where the Customer is legally a Consumer; business customers are governed by the agreed business terms and mandatory law.

9. Content, intellectual property and acceptable use

9.1. Customers retain rights to their images, text, marks and other content. By uploading content, they grant CocoBook a non-exclusive permission to host, copy, display and technically process it only as necessary to deliver selected features and comply with lawful instructions.

9.2. CocoBook software, design, marks and platform components remain the property of the Provider or licensors. Customers receive a limited right to use the service during the subscription.

9.3. Illegal, fraudulent, deceptive or infringing content, unauthorised disclosure of personal data, malware, unauthorised data extraction, circumvention of security controls and interference with the service are prohibited.

9.4. Integrations and external services (including iCal syncing where available) are also subject to the third party’s terms. CocoBook cannot guarantee ongoing compatibility with third-party systems.

10. Illegal content notices (Digital Services Act)

10.1. Notices of allegedly illegal content may be submitted via [CONTENT_NOTICE_URL] or dsa@cocobook.app. They should include the relevant content URL, reasons for the notice, contact details and a good-faith statement where applicable.

10.2. The Provider assesses notices promptly, objectively and non-arbitrarily and may take proportionate steps, such as warning, restricting visibility, removing content or suspending an account. It supplies reasons and remedies where required by Regulation (EU) 2022/2065.

10.3. Restrictions are based on law and Section 9. Decisions take account of severity, context, repeated violations, affected interests and fundamental rights. Automated content-moderation tools: [YES/NO AND VERIFIED DESCRIPTION].

10.4. Where an internal complaints mechanism is legally mandatory, details and applicable out-of-court remedies will be provided at [COMPLAINTS_URL]. The DSA contact point for authorities and recipients is dsa@cocobook.app, accepting Bulgarian and English.

11. Availability, data export and termination

11.1. The Provider uses reasonable professional efforts for security, maintenance and availability, but scheduled downtime, incidents and third-party outages may occur. Mandatory consumer rights regarding conformity of digital services are preserved.

11.2. Customers may cancel future renewal as described in Section 7. The Provider may restrict or terminate access for material breaches, repeated misuse, legal orders or non-payment, subject to notice where required and feasible.

11.3. Customers should be able to request or export their data before permanent deletion via [EXPORT_PROCESS]. Retention and deletion after account termination are described in the Privacy Policy and any data processing agreement, subject to legally required retention.

11.4. On termination, hosted public websites and directory listings may be deactivated in accordance with the selected plan and notice provided.

12. Personal data

12.1. Processing performed by CocoBook as an independent controller is explained in its Privacy Policy.

12.2. Where the Customer decides why and how its guests’, booking subjects’ or team members’ information is processed, the Customer is generally the controller and CocoBook acts as a processor. This relationship should be governed by a separate Article 28 GDPR data processing agreement (“DPA”).

12.3. The Customer must provide its own appropriate privacy information and legal basis to people submitting enquiries through its site. CocoBook’s privacy policy does not automatically replace the Customer’s notice.

13. Liability

13.1. CocoBook remains responsible for its own contractual and statutory duties as a digital service provider. It is not responsible as an accommodation provider for the condition of properties, actual stays, guest arrangements or the Customer’s representations.

13.2. The Provider does not promise the correctness of Customer-entered data, particular financial results or the elimination of double bookings arising from inaccurate data or failures of external channels.

13.3. No provision excludes liability for wilful wrongdoing, gross negligence, non-excludable statutory obligations, mandatory consumer remedies or any other liability that cannot lawfully be excluded.

14. Changes, governing law and complaints

14.1. The Provider may amend these Terms to reflect legal, feature or commercial changes. Material changes are communicated in advance by email or within the application. Existing paid contracts and consumer rights will not be altered contrary to mandatory law; Customer consent will be obtained where required.

14.2. Bulgarian law governs, without depriving Consumers of mandatory protections of the laws of their habitual residence where applicable under EU law.

14.3. SaaS-related complaints may be sent to info@cocobook.app. Consumers may use competent supervisory bodies, available alternative dispute resolution procedures and courts. No provision removes mandatory jurisdiction or access to justice.

14.4. The current Terms are available at https://cocobook.app/terms. Contact: info@cocobook.app.
